Law Commission agrees UCC not practical in India, says Muslim body
New Delhi, July 31 : The All India Muslim Personal Law Board (AIMPLB) on Tuesday claimed that the Law Commission in principle agrees that a uniform civil code (UCC) is not practicable in India given the country's vast diversity and complexities.
The Law Commission has been examining the issue of implementing a common civil law for all communities in India and had invited the AIMPLB on Tuesday to discuss the Muslim personal law and the desired changes in it.
"First and foremost we made it clear that Muslim personal law is as per the divine decree and nobody is authorised to change it. The Commission was very receptive of our views and the meeting happened in a very cordial atmosphere," said Maulana Syed Jalaluddin Umari, who led the AIMPLB delegation.
"The Law Commission Chairman admitted that a uniform civil code is not a practical idea for India and that the government should not even think of implementing it for at least 10 years. We told him that not just 10 years, the idea should be dropped for good," Umari said.
Syed Qasim Rasool Ilyas, a member of the delegation, said the Commission discussed as to what good things from the Muslim personal law can be made part of the Hindu civil code and vice versa.
"We are clear that we cannot tweak our personal law at will. It is based on Quranic injunctions and the Hadith," he said.
Advocate Niaz Farooqi said that when the delegation requested the Commission that before making any law about Muslims, it should at least consult the community, they were shocked to hear the reply.
"The Chairman said that the government was not even consulting the Law Commission on such matters, let alone others. This clearly shows that the Narendra Modi government is more interested in doing politics on Muslim issues than actual reform," Farooqi said.
AIMPLB spokesman Kamal Farooqui said: "Today we have submitted a detailed note on the questions raised by the Law Commission. The issues pertained to inheritance, adoption, custody of children, making a will, difference in interpretation of Islamic laws among various sects and model nikahnama."
In response to a question, Farooqi said that nikah halala had no backing in the Shariah.
"I can tell you with full authority that there is no concept of nikah halala in the Shariah. The debate around it is more a media creation," Farooqui said.

Hubballi: Gym trainer assaulted; police say clash due to personal reasons
Hubballi: A gym trainer was allegedly assaulted by a group of people following accusations of sexual assault and ‘love jihad’, even as both families involved in the case traded serious allegations.
According to police, a group of individuals went to the residence of Sameer Mulla, a resident of Vijayanagar, and questioned him over his friendship with a woman he had met at a gym. The situation escalated into a clash, during which he was allegedly dragged away and assaulted. He sustained minor injuries and was admitted to KIMS hospital.
N. Shashikumar said that after this incident, members from Sameer’s side went to the woman’s house, leading to another clash in which one person was injured. “It was wrong for groups to go near houses. We will take necessary legal action,” he said, adding that the incident appears to have arisen from personal reasons. Police have taken some individuals into custody and are investigating the matter.
Sameer Mulla was reportedly thrashed by a group of Sangh Parivar activists and later handed over to police at the Old Hubballi Police Station after relatives of the woman and members of Hindu organisations gathered at his residence in Rajnagar.
The woman’s family alleged assault and threats from Sameer’s relatives at their Vikas Nagar residence.
Meanwhile, Sameer’s family denied the allegations and accused the woman’s relatives and others of assaulting and kidnapping him. His sister said the two had been in a relationship for three years and that the allegations were baseless.
Police said statements from both sides have been recorded, and a detailed investigation is underway. Sameer remains hospitalised, and appropriate legal action will be taken based on findings.
In a video statement shared on social media, the 20-year-old woman alleged that Sameer had given her an intoxicant, recorded videos without her consent, and sexually assaulted her. She lodged a complaint alleging rape and blackmail, which police are investigating.
In another video, Sameer denied the allegations, claiming the video was recorded with consent and that the accusations were made under pressure.
Former Hubballi-Dharwad Urban Development Authority (HDUDA) chairman Nagesh Kalburgi termed the incident a serious matter and urged police to take strict action.
Police said the case involves multiple complaints from both sides, and further investigation is underway.
