New Delhi: Opposition Members of Parliament, including senior leaders like Kapil Sibal and Vivek Tankha, submitted a notice in the Rajya Sabha on Friday seeking the impeachment of Allahabad High Court Judge Shekhar Kumar Yadav. The move comes in response to alleged controversial remarks made by the judge at a Vishva Hindu Parishad (VHP) event.
The notice, signed by 55 MPs from various opposition parties, was submitted under the Judges' (Inquiry) Act, 1968, and Article 218 of the Constitution. The MPs met the Rajya Sabha Secretary-General to hand over the motion, sources confirmed.
The impeachment notice alleges that Justice Yadav’s speech at the VHP event violated constitutional principles. It stated that the judge “engaged in hate speech and incitement to communal disharmony,” displaying bias against minorities and advocating politically sensitive matters, including the Uniform Civil Code, in contravention of the Restatement of Values of Judicial Life, 1997.
At the VHP event on December 8, Justice Yadav reportedly described the Uniform Civil Code as a means to promote social harmony, gender equality, and secularism. However, videos of the judge making provocative statements, including claims about laws functioning in favour of the majority, surfaced on social media, drawing sharp criticism from opposition leaders and activists.
The Supreme Court has taken note of media reports regarding Justice Yadav's remarks and has sought details from the Allahabad High Court on the issue.
