In the background of petition filed against the unlawful demolition of Gareeb Nawaz Mosque in Uttar Pradesh, the Allahabad High Court has issued show cause notice to SHO, Ram Sanehi Ghat to explicate questioning why contempt proceedings should not be initiated against him for passing the order for demolishing of Gareeb Nawaz Masjid in violation of the High Court's directions. The HC had previously directed that the order of eviction or demolition shall remain in abeyance till May 31, due to the covid 19 pandemic. 

The case revolves around the demolition of the Gareeb Nawaz Mosque that occurred on May 17, in Barabanki District of Uttar Pradesh, whereby the district administration claimed it to be an "illegal structure" and undertook its demolition.

The bench comprising of single judge Justice Ravi Nath Tilhari observed thus:

"From the averments made in the contempt petition as also the submissions advanced, prima facie, it appears that the demolition of the mosque in question on 17.05.2021 by the respondent No. 2-Station House Officer, Ram Sanehi Ghat, Tehsil and District Barabanki, as stated, is in violation of the directions No. 4 and 5 of the order dated 22.04.2021 passed in P.I.L. No. 564 of 2020."

Appearing on behalf of the petitioner applicants, Senior Advocate Kapil Sibbal submitted before the Court that there had been a 'willful disobedience of the directions passed by the High Court, wherein the Court had passed directions with regards to the extension of interim orders, bail orders and other eviction or demolition orders passed by the Court in wake of the increase in covid 19 cases.

Direction 4 of the said order stated, "That any orders of eviction, dispossession or demolition, already passed by the High Court, District Court or Civil Court, if not executed till the date of passing of this order shall remain in abeyance for the period till 31.05.2021."

According to the petitioner, it was submitted that as per the said direction, the district administration had demolished the mosque on May 17 in the execution of the order dated 3rd April of the SDM, Ram Sanehi Ghat executed by the SHO which is in grave violation of the HC’s directions.

In view of the affidavits filed by the SDM and SHO, the High court directed, “Accordingly, issue notices to respondent no. 2 to file a response and to show cause as to why the proceedings for contempt be not initiated against him. Appearance is through counsel."

The matter will now be deliberated on July 22.

Bareilly (UP) (PTI): A local court here has sentenced a man to life imprisonment for murdering his mentally challenged wife by repeatedly electrocuting her while she was tied to a cot, lawyers said on Thursday.

Additional district government counsel Harendra Singh Rathore said Additional Sessions Judge Avinash Kumar Singh on Wednesday convicted Vinod Kumar (45) for killing his wife, Satyavati, in Chaina village of Bareilly district and imposed a fine of Rs 15,000 on him.

According to the prosecution, he was allegedly frustrated with his wife Satyavati's mental illness and often assaulted her.

Rathore said the prosecution examined nine witnesses to establish the charges against him.

As per court records, on the night of May 1-2, 2022, when Satyavati was asleep, Vinod tied her hands and legs to a cot using ropes and then connected an aluminium cable to an electric board to repeatedly administer electric shocks to her.

"She writhed in pain, but the accused continued to electrocute her until she died," the prosecution said.

The court observed that the murder was carried out in an inhuman manner.

After committing the crime, the accused threw the rope and cable on the roof and left for work at a brick kiln around 2 am to create a false alibi.

He later tried to mislead the police and the victim's family by claiming that Satyavati, whose mental condition was unstable, had accidentally died by suicide after grabbing a live electric wire.

However, the victim's brother, Sanjeev, a resident of Shahjahanpur district, suspected foul play and lodged an FIR under sections 498A (husband subjecting wife to cruelty) and 302 (murder) of the Indian Penal Code at Nawabganj police station.

During the trial, the prosecution relied on the post-mortem report prepared by Dr Faraz Anwar, who stated that multiple electrocution marks found on different parts of the victim's body could not have been self-inflicted.

The police also recovered the rope and electric wire used in the crime on the accused's identification, officials said.
