Bengaluru: In a significant decision, the High Court has canceled the circular issued by the Karnataka state government regarding the state-level board examinations for students in classes 5, 8, and 9 of state curriculum schools.
The state government had previously announced its intention to replace school-level assessments with state-level board examinations for these classes. Following a petition filed by the Union of Unaided Private Schools challenging this circular, Justice Ravi Hosmani, heading a single-member bench, delivered the verdict.
While a detailed copy of the order is awaited, the High Court's decision has led to the cancellation of board exams scheduled from March 9 to 11.
The State Education Department had issued two circulars on October 6 and 9, 2023, under the Education Act, proposing to conduct these board exams. The petitioner association argued that the Education Department's circular only applied to government school students and was not part of the syllabus for private schools. They contended that the learning recovery syllabus questions would be challenging for private school students, who follow a different curriculum.
Advocates for the government argued that the learning recovery syllabus is part of the curriculum and is designed to enhance children's intelligence positively. They stated that the questions would be based on this syllabus, which is derived from the general curriculum.
After considering these arguments, the High Court canceled the government's order, effectively halting the board exams for these classes.
