Fahad Shah, the editor-in-chief of the magazine ‘thekashmirwalla’ was arrested again by the Shopian Police for the third time in a month. This was hours after getting bail from a Shopian court over a case concerning his reporting of a 2020 encounter in Srinagar, reported The Indian Express.

Speaking while granting bail to Fahad, Shopian court magistrate Sayeed Qayoom noted, “In a barbaric society you can hardly ask for bail and in a civilized one, you can hardly refuse it,” adding that “bail is a rule and its refusal is an exception”.

He was earlier taken into custody by the Pulwama police on 4 February, for the next 22 days. On 26 February, after a special court granted bail under the NIA Act, he was arrested again by the Shopian police on Saturday in light of his social media posts “tantamount to glorifying the terrorist activities and causing dent to the image of law enforcing agencies besides causing ill-will & disaffection against the country”, noted the J&K police.

They also noted that Fahad Shah was wanted in three cases including “glorifying terrorism, spreading fake news & inciting general public for creating law and order (L&O) situations.

Shah is currently in custody with the Safakadal police station.

The subsequent arrest in Shopian after the first bail came in a case filed in January, by the Army against two news portals including ‘thekashmirwalla’ under Sections 153 (provocation with intent to cause riot) and 505 (statements conducive to public mischief) of the Indian Penal Code. This was pertaining a report published in his magazine alleging a local army unit “of forcing an Islamic seminary school to hold Republic Day celebrations on January 26”, the report said.

Moreover, an FIR was filed for the third time after he published a story quoting the family members of a deceased militant refusing police claims. The report said that police have contested the claims of Shah’s report.
