New Delhi: Data released by the Ministry of External Affairs (MEA) in response to a Right to Information (RTI) query shows that 5,383 complaints against illegal recruitment agents were forwarded to state and Union territory governments for investigation between January 2021 and February 2025. The RTI application was filed by transparency campaigner Commodore Lokesh K. Batra (Retd.).

Andhra Pradesh accounted for the highest number of complaints during this period, with 2,890 cases forwarded. However, only 16 Action Taken Reports (ATRs) were submitted by the state police, and the MEA issued just one prosecution sanction for the state.

In comparison, Kerala had 531 complaints forwarded, leading to 17 prosecution sanctions after investigations. Delhi saw a sharp rise in complaints in 2024 and early 2025, with a combined total of 207 complaints resulting in 11 prosecution sanctions in 2024.

Punjab recorded 103 complaints but received no prosecution sanctions. Gujarat had 15 complaints, leading to one sanction against four individuals in early 2025. Haryana registered seven complaints, with one prosecution sanction issued in 2024.

Despite the large number of complaints, only 756 ATRs were submitted by state police authorities during the entire period. The MEA stated that prosecution sanctions were issued in all 49 cases where a formal request was made by State/UT authorities following their investigations.

The MEA's reply also included a memorandum dated September 25, 2024, which outlines a standard operating procedure (SOP) for State/UT police authorities. The SOP is designed to ensure safe and legal migration while guiding officials on tackling illegal recruitment and human trafficking. The MEA reiterated that law and order is a state subject.
