New Delhi: Rahul Gandhi, the former president of the Indian National Congress, has approached the Supreme Court with a petition challenging the Gujarat High Court's decision to reject his request for a stay on his conviction in a criminal defamation case. This case revolves around his controversial 'Modi surname' remark, which ultimately resulted in his disqualification as a Member of Parliament earlier this year.

On March 24, 2023, Rahul Gandhi was disqualified as a Lok Sabha MP after a Gujarat court found him guilty of criminal defamation and sentenced him to two years in prison for his comments regarding the Modi surname.

If the Supreme Court grants a stay on his conviction, it will pave the way for his reinstatement as a Lok Sabha MP. However, he has not yet received any relief from either the sessions court or the Gujarat High Court regarding his conviction.

The complainant in this case is Purnesh Modi, a Bharatiya Janata Party (BJP) Member of the Legislative Assembly (MLA). Earlier, Purnesh Modi had filed a caveat in the Supreme Court, ensuring that he would be heard if Rahul Gandhi moves a plea challenging the high court's verdict.
