New Delhi: Supreme Court upheld the constitutional validity of the Uttar Pradesh Board of Madarsa Education Act, 2004, on November 5, 2024, reversing the Allahabad High Court's earlier ruling that deemed it unconstitutional.
However, the Court declared that provisions of the Act regulating higher education degrees, specifically 'fazil' and 'kamil,' conflict with the University Grants Commission (UGC) Act, rendering those aspects unconstitutional.
A bench comprising Chief Justice DY Chandrachud, Justice JB Pardiwala, and Justice Manoj Misra reviewed the case, which contested the High Court's decision from March 22 that struck down the Madarsa Act.
