'Why only target Air India which faced unfortunate tragedy?' SC junks PIL for safety audit
New Delhi, Aug 8 (PTI): The Supreme Court on Friday refused to hear a plea to appoint a retired top court judge for examining Air India's safety practices among other aspects and asked the petitioner why target the airline that witnessed an "unfortunate tragedy".
A bench of Justices Surya Kant and Joymalya Bagchi told the petitioner in-person Narendera Kumar Goswami to withdraw his PIL and asked him to move the appropriate forum in case of grievances.
"Don't give the impression that you are playing with other airlines. Why target Air India only which recently witnessed an unfortunate tragedy? If you want some regulatory mechanism in place, then why did you not make other airlines as party in your petition? Why only Air India?" the bench asked Goswami, a lawyer.
The petitioner claimed to be a victim of "some unfortunate incident" with the airline.
Justice Kant then told him, "We also travel every week and know what is the status. There was a tragedy, a very unfortunate one. This is not a time to run down an airline."
Goswami in his PIL, which he filed in July, sought directions for constituting an independent committee, headed by a retired Supreme Court judge to examine Air India's safety practices, maintenance procedures, and operational protocols, with a report to be submitted within three months.
He also sought a direction for a comprehensive safety audit of Air India's entire fleet by an international aviation safety agency accredited by the International Civil Aviation Organization (ICAO), addressing deficiencies identified in the 2024 ICAO audit report, to be completed within six months.
Additionally, Directorate General of Civil Aviation was sought to be directed to implement and enforce a transparent, publicly accessible reporting system for all aviation safety incidents, including a centralized database, ensuring compliance with the Aircraft Rules, 1937, and international best practices.
The PIL further sought a direction to Air India to provide compensation to the families of AI-171 crash victims in accordance with the Montreal Convention, 1999, and to offer ex-gratia payments or compensation to passengers of AI-143 for distress and inconvenience caused by the safety incident, as per applicable laws and industry standards.
The London-bound Air India flight, Boeing Dreamliner 787-8, with 242 passengers and crew on board, crashed moments after taking off from the Sardar Vallabhbhai Patel International Airport in Ahmedabad on the afternoon of June 12.

Women BJP MLAs protest against opposition in UP assembly premises
Lucknow (PTI): Women BJP MLAs held a protest in the Vidhan Bhawan complex before the one-day special session of Uttar Pradesh assembly, slamming the opposition for defeating the passage of a bill, which would have led to implementation of the Women's Reservation Law, in the Lok Sabha.
This followed another demonstration by Samajwadi Party MLAs, who alleged that the BJP was misleading public in the name of women's reservation.
The women BJP legislators assembled in front of Chaudhary Charan Singh's statue in the assembly premises, holding banners inscribed with the slogan "Insult to Matrushakti (women's power), India will not tolerate it". The protesting members entered the main hall of Vidhan Bhawan carrying the banners.
Participating in the protest, the state Minister for Women Welfare and Child Development, Baby Rani Maurya, told reporters that all opposition parties, including the Samajwadi Party and the Congress, had opposed the women's reservation, a stance for which they would have to pay a heavy political price.
"On this issue, all of us women stand united. We will ensure that we secure our reservation," she said.
BJP MLA Ketki Singh remarked that their protest represents the collective outrage of millions of women across the state.
Singh asserted that the opposition has betrayed women by creating hurdles in the path of women's reservation. The current demonstration is merely the beginning, and very soon, women from every street, intersection and household will join the protest movement, she said.
Minister Vijaylakshmi Gautam said, "We strongly condemn the despicable act committed by the Samajwadi Party and the Congress in an attempt to hold back 'half the population' (women). Their action was directed against the very bill that Prime Minister Narendra Modi had introduced to empower and strengthen Nari Shakti (women's power), and which he strived to pass expeditiously."
Uttar Pradesh assembly is holding a one-day special session on Thursday. During the session, the government is set to move a censure motion against the opposition parties over their failure to pass the Constitution Amendment Bill, which would have led to implementation of the Women's Reservation Act, in the Lok Sabha.
