SC stays take over of land of Azam Khan's Mohammad Ali Jauhar University
New Delhi, Apr 18: The Supreme Court Monday stayed the takeover of the land of Mohammad Ali Jauhar University in Rampur initiated by the Uttar Pradesh Government for nonadherence to certain conditions on which the land for the institution was granted to a trust run by Samajwadi Party leader Azam Khan in 2005.
A bench of Justices Ajay Rastogi and C T Ravikumar issued notice to the Uttar Pradesh government and others on the appeal filed against the Allahabad High Court order.
The High Court had in September last year dismissed the petition filed by Maulana Mohammad Ali Jauhar Trust seeking quashing of a report submitted by Sub-Divisional Magistrate (SDM) in March 2020 on the constructions over the land as well as the order dated January 16, 2021, by Additional District Magistrate (Administration) Rampur for vesting of the land in the state.
Both Azam Khan and his son Abdullah are currently lodged at Sitapur district jail and are facing several cases.
Citing the SDM's report, the high court had said a mosque was constructed over the land which was only for educational purposes, and thus, is a violation of the permission granted by the state government.
The high court had said that no interference was required in the order passed by the ADM to initiate proceedings under Section 104/105 of the UP Revenue Code, 2006 for vesting of University's land in UP Govt i.e. taking over the land given to the Trust.
In 2005, the then Samajwadi Party government enacted the Mohammad Ali Jauhar University Act, paving the way for the creation of the university.
Thereafter, the state government granted permission to the Trust to acquire 400 acres of land against the ceiling of 12.5 acres (5.0586 hectares) for the establishment of the University while imposing certain conditions, one of which was that the land will be used only for educational purposes.
According to law, if such a condition is violated, the permission granted by the state government stands withdrawn.

West Bengal Class 12 results declared; overall pass percentage 91.23%
Kolkata (PTI): The West Bengal Council of Higher Secondary Education on Thursday announced the results of its Class 12 examination, which recorded an overall pass percentage of 91.23 per cent.
The results included those of the candidates from the fourth semester under the new system, supplementary candidates of the third semester, and students appearing under the old annual examination pattern.
While the pass percentage among girls stood at 92.47 per cent, boys recorded a pass percentage of 89.71 per cent.
As many as 64 candidates -- including 56 boys and eight girls -- featured in the top 10 list. Adrito Pal of Narendrapur Ramakrishna Mission Vidyalaya secured the first rank in the state by scoring 496 out of 500 marks.
Jishnu Kundu of Ramakrishna Mission Vidyapith Purulia and Ritobrata Nath of Narendrapur Ramakrishna Mission Vidyalaya secured the second rank with 495 marks each.
Candidates dissatisfied with their fourth-semester results would be allowed to reappear in the examination next year after surrendering the current year's result.
According to official data, a total of 7,10,811 candidates appeared for the higher secondary examination this year.
Of them, 6,35,864 students appeared in the final semester examination under the new system, 59,452 candidates took the supplementary examination for the second semester, and 15,495 students appeared under the old annual examination pattern.
Chief Minister Suvendu Adhikari congratulated all students who have passed the higher secondary examination in a post on X.
"Your hard work, perseverance, and self-confidence have taken the form of success. May the success inspire you to dream even bigger on the path ahead. I wish that your future be bright, that you get success in every field and that you bring glory to your family, society, and state," he wrote on social media.
